1. Acceptance of Terms

By accessing or using the Refgrow platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Refgrow provides a SaaS platform for creating and managing affiliate and referral programs. These Terms govern your use of the platform, including the embeddable widget, tracking scripts, API, and dashboard.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to use Refgrow. By creating an account, you represent that you meet this requirement.

3. Service Description

Refgrow allows you to create affiliate programs for your SaaS products. Features include referral tracking, conversion attribution, automated commission payouts, customizable widgets, and integrations with payment processors such as Stripe, Paddle, LemonSqueezy, Polar, and Dodo Payments.

4. Subscription and Billing

Refgrow offers free and paid subscription plans. Paid plans are billed on a monthly basis. You can cancel your subscription at any time, and your access will continue until the end of the current billing period.

We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing period.

5. Usage Limits

Each plan includes specific limits on the number of programs, affiliates, referrals, and tracked revenue. If you exceed your plan limits, we may restrict certain features until you upgrade or reduce usage.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Engage in fraudulent affiliate activity, including self-referrals or fake conversions
Attempt to circumvent fraud protection mechanisms
Interfere with or disrupt the Service or its infrastructure
Reverse engineer, decompile, or disassemble any part of the Service
Use the Service to distribute malware, spam, or other harmful content

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your use of Refgrow complies with applicable data protection laws, including GDPR where applicable.

8. Intellectual Property

Refgrow retains all rights, title, and interest in the Service. You retain ownership of the data you submit to the Service. You grant us a limited license to use your data solely to provide the Service.

9. API Usage

Access to the Refgrow API is subject to rate limits and usage restrictions as described in the API documentation. API keys must be kept confidential and should not be shared publicly.

10. Payouts

Commission payouts to affiliates are processed through PayPal or Wise. Refgrow facilitates the payout but is not responsible for delays caused by third-party payment processors. Minimum payout thresholds and hold periods may apply.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time. Upon termination, your data will be retained for 30 days, after which it may be permanently deleted.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the maximum extent permitted by law, Refgrow shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
